Learned counsel for the petitioner has sought grant of regular bail in FIR No. 150 dated 03.07.2024, registered under Sections 115, 117(3), 190, 191(3), 351(2), 351(3), 109 and 324 of the Bharatiya Nyaya Sanhita at Police Station Sadar Jagadhri, District Yamuna Nagar.

It is the case of the petitioner that he has been in judicial custody since 28.08.2024 and has thus undergone incarceration for more than one year and four months as an under-trial prisoner. It is further submitted that out of a total of 22 prosecution witnesses, only 5 witnesses have been examined till date. Learned counsel for the petitioner also submits that the co-accused, who are similarly situated, have already been granted the concession of bail by a Co-ordinate Bench of this Court vide order dated 24.07.2025 passed in CRM-M-13914 of 2025 and CRM-M-57937 of 2024.

Admittedly, the present petitioner as well as the co-accused are alleged to have caused injuries collectively, and the co-accused have already been released on bail.

In these circumstances, when the case of the petitioner is similar to that of the co-accused and the co-accused are already on bail, the present petitioner is also entitled to the concession of bail on the grounds of parity, prolonged period of custody, and the likelihood of the trial taking time. Accordingly, the petitioner is ordered to be released on bail on furnishing adequate bail/surety bonds to the satisfaction of the trial Court/CJM concerned.
