The matter is taken up through hybrid mode.

Heard Mr. K.K. Mishra, learned counsel for the Petitioner, Mr. R.K. Mahalik, learned counsel for Opposite Parties 5 to 11 and Mr. S. Ghose, learned AGA.

It is stated by Mr. Mishra, learned counsel for the Petitioner that the Tahasildar is now proceeding in the matter taking advantage of order of this court passed in WP(C) No.29321 of 2023, despite the appeal is pending before the Collector & District Magistrate.

It is seen that in WP(C) No.29321 of 2023, this court by order dated 11th December, 2023 has directed the Tahasildar to proceed in accordance with law in terms of the order of the Sub-Collector, Champua dated 23rd May, 2023. It appears that said order of this court has been obtained by the concerned Petitioners, who are Opposite Parties in the present writ petition, by suppressing the fact that appeal has been preferred against the order of Sub-Collector before the Collector & District Magistrate.

Accordingly it is directed that during pendency of Regulation Appeal No.7 of 2023 before the Collector & District Magistrate, Keonjhar, there shall be stay of further proceeding in the execution case before the Tahasildar or subject to such order passed by the Collector & District Magistrate.

The writ petition is accordingly disposed of.
