The present petition has been filed seeking protection of life and liberty of the petitioners at the hands of private respondents No.4 and 5 and their other relatives.

Petitioner No.1 (girl) is of the age of 35 years, whereas petitioner No.2 (boy) is aged 31 years. The marriage of petitioner No.1 was solemnized with one Vijay Kumar on 15.04.2009 and out of the said wedlock, one daughter and one son was born, who are living with petitioner No.1. Due to matrimonial dispute between the petitioner No.1 and said Vijay Kumar, petitioner No.1 parted her ways from her husband and has decided to live with petitioner No.2, who is a divorcee. As petitioner No.1 has not got divorce from said Vijay Kumar, both the petitioners are residing in live-in-relationship. It is averred that the petitioners are apprehending threat to their lives and liberty at the hands of private respondents No.4 and 5.

Learned counsel for the petitioners has submitted that the husband of petitioner No.1, namely, Vijay Kumar is a drug addict and also beats up petitioner No.1 and so as to save her life, petitioner No.1 has now started living with petitioner No.2 since there is no other place for her to go and stay. He further submitted that the scope of the present petition pertains only to the protection of lives of the petitioners. He has submitted that the petitioners have submitted a representation dated 08.09.2023 (Annexure P-3) to respondent No.2-Senior Superintendent of Police, Hoshiarpur, but no action has been taken on the same.

This Court does not wish to make any observations with regard to the validity of INTER SE relationship between the petitioners. However, since both the petitioners are stated to be residing in live-in relationship, the scope of present petition pertains only to protection of their lives.

The present petition is disposed of with a direction to respondent No.2-Senior Superintendent of Police, Hoshiarpur that representation dated 08.09.2023 (Annexure P-3) filed seeking protection of life and liberty of the petitioners, be looked into and contents thereof be duly verified and if necessary, requisite steps be taken, strictly in accordance with law for ensuring the protection of life of the petitioners.
