 Learned counsel for the applicant submits that this third application under Section 438 of Cr.P.C. has been filed because earlier the benefit of
anticipatory bail was granted to the applicant by this Court vide order dated 02.07.2020 passed in MCRC 17367/2020 directing police not to arrest the
present applicant till the investigation completes. The said benefit was further extended by this Court for a further period of two months vide order
dated 05.11.2020 passed in MCRC No.38449/2020. He submits that the investigation is yet to be completed, but the police is trying to arrest the
present applicant. Therefore, applicant may be granted permanent anticipatory bail or the order dated 02.07.2020 passed in MCRC 17367/2020 may
be extended.
On being asked, learned counsel for the respondent-State submits that he does not have any concrete information about the status of the investigation.
However, considering the nature of crime and the orders passed by this Court on earlier occasions, it is very surprising as to why the investigation is
still going on and not completed so far. Therefore, learned counsel for the respondent-State is directed to ask the investigating officer to complete the
investigation as early as possible.
Considering the aforesaid facts and circumstances of the case, the benefit of anticipatory granted to the applicant vide order dated 02.07.2020 passed
in MCRC 17367/2020 is again extended till the investigation completes. It is directed that the applicant shall not be arrested arrested by the police till
the investigation completes.
With the aforesaid, this application stands allowed and disposed of.
