Judgment
The complainant being the Special Judicial Magistrate, N.I. Act Cases No.2, Udaipur has forwarded the instant contempt petition under Section 12 of the Contempt of Courts Act, 1971 with grave and disturbing allegations against the contemnor advocates who are Office Bearers and Members of the Bar Association, Udaipur. As per the complaint, on 10.06.2022, the Presiding Officer was undertaking proceedings of recording the statement of a victim under Section 164 Cr.P.C., the respondent contemnors forcibly took away the policeman who had brought an accused in the Court through production warrant and raised slogans forcing the Presiding Officer to leave the Court. The doors of the Court were bolted from outside.
Though in the initial submissions made on behalf of the respondents contemnors, they have tried to deny the allegations levelled in the contempt application claiming that they were not present in the incident but during the course of hearing, learned counsel representing the respondents on instructions, have filed fresh affidavits of the contemnors wherein, they have expressed unconditional apology for the incident and have given an assurance that such conduct shall not be repeated in future.
In view of the facts and circumstances as noted above and as the respondents being responsible Members of the Bar Association, Udaipur have candidly conceded to their mistakes and have tendered unconditional apology for the same and have also given an assurance that the same shall not be repeated in future while holding the respondents responsible for the unfortunate incident, we hereby let them off with a warning and advise to remain careful in future. The contempt proceedings are closed. Rule is discharged.
