Judgment
The only question which remains for discussion in this writ petition is about the grant of interest for delayed payments made after the death of Rama Swami husband of the petitioner who died on February 03, 1998. Ex gratia payment of Rs. 50,000/- was made near about 26th November, 2001; payment on account of Death-cum-Retirement Gratuity to the tune of Rs. 31,422/- was made on 1st August, 2001 and on account of C.I.S. amount of Rs. 15,000/- on February 28, 2002.
As far as ex gratia amount is concerned, no interest is payable to the petitioner Anjali, widow of Rama Swami as it was ex gratia amount payable. As far as the other two items are concerned, as per rules, 12 per cent interest is directed to be paid by the respondents to the petitioner after six months of the death of Rama Swami i.e. with effect from August 03, 1998 till payment. This disposes of this writ petition.
Let the directions be committed within two months. If the respondents object to the order proposed, High Court may be moved for disposal of the writ petition on merits according to law within two months.
Copy of the order be supplied to the counsel/parties. File of the case be returned to the Registry of the High Court.
