The instant petition has been filed by the petitioner for the grant of following substantive relief:

“That the respondents may kindly be directed to grant the family pension in favour of the petitioner with all consequential benefits.â€​

It appears that the petitioner instead of approaching the competent authority for the grant of family pension has simply rushed to this Court.

Therefore, in the given circumstances, we dispose of the instant petition by permitting the petitioner to apply to the concerned authority for the grant

of family pension in accordance with the rules by submitting an application on prescribed format alongwith the documents within a period of four

weeks from today and on receipt thereof, the competent authority shall process and proceed to decide the claim of the petitioner in accordance with

law and if entitled, the petitioner be granted the family pension within a period of two months on receipt of such application.

Pending application(s), if any, also stands disposed of.

For compliance, to come up on 24.02.2021.
