Vijay Manohar Sahai and Jayashree Tiwari, JJ.—We have heard Sri K. C. Shukla, learned Counsel for the appellant and learned standing counsel appearing for the respondents No. 1, 2, 4 and 5. Sri Tej Bhan Singh has accepted notice for respondent No. 3.

This intra Court appeal has been filed by the appellant challenging the order dated 3.5.2010, passed by the learned single Judge in Civil Misc. Writ Petition No. 24250 of 2010 by which the writ petition filed by the appellant had been dismissed.

The facts in brief are that the petitioner applied for admission to Special Basic Training Course-2008. She had applied in the category of Home Science and the word ''Home Science1 had specifically been written by her in her own hand writing in columns 9 and 11 of the application form. The Principal, District Education and Training Institute, Jafarpur, Azamgarh has passed the impugned order holding that the petitioner is not B.Sc. with Home Science as one of the subjects nor did she enclose any mark-sheet of B.Sc. Home Science, therefore, she was not eligible to be considered for admission in accordance with the Government order as well as in terms of advertisement for admission to Special Basic Training Course, 2008.

It is admitted to the learned Counsel for the appellant that the appellant has graduated in Arts with Home Science as one of the subjects and has urged that the appellant is entitled to be considered for admission to Special Basic Training Course, 2008. The argument of the learned Counsel for the appellant is that the appellant has done B.A. with Home Science and, therefore, she is entitled to be considered for admission alongwith candidates having done B.Sc. with Home Science as one of the subjects cannot be accepted. The appellant cannot be said to have passed B.Sc. with Home Science and therefore, the learned single Judge has rightly dismissed the writ petition filed by the appellant.

We do not find any merit in this appeal. This appeal fails and is accordingly dismissed.
