This is the second application filed by the applicant under Section 439 of the Cr.P.C. seeking regular bail. Earlier application (M.Cr.C. No.30982/2020)

was dismissed on merits on 16.10.2020.

The applicant is in custody since 11.08.2020 in connection with Crime No.565/2020 registered at Police Station- Kolgawan district -Satna for

commission of offences punishable under Sections 294, 323, 324, 506, 326 and 307 read with Section 34 of the Indian Penal Code.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated because of old enmity. It is also contended

that persons from both the side sustained grievous injuries. It is also submitted that counter case has also been registered against the complainant party

on the report lodged by the applicant. Due to Covid-19 pandemic, trial would take considerable time, therefore, it is prayed that the applicant be

granted bail.

Learned Panel Lawyer for the State submitted that Ashish sustained grievous injuries and he was admitted in hospital. It is also contended that the

applicant sustained simple injuries.

Heard learned counsel for the parties.

On perusal of the record, it is found that applicant served more than 4 months of detention and he also sustained grievous injuries because of which

counter case has also been registered against the complainant party on the report lodged by the applicant at the same Police Station as Crime

No.564/2020 for the offence punishable under Sections 323, 325, 506 & 34 of the I.P.C.

It is directed that applicant-Anirudh Mishra @ Annu be released on bail on furnishing a personal bond in the sum of Rs. 50,000/- (Rupees Fifty

Thousand only) with one solvent surety, in the like amount to the satisfaction of the concerned trial Court for his appearance on the dates so fixed by

that Court during trial.

The applicant shall comply with the provisions of Section 437 (3) of the Cr.P.C.

Accordingly, the application is allowed and disposed of.
