THE complainant is the wife of the deceased insured Natvarlal Ambalal Patel. THE deceased was holding 4 insurance policies whose particulars are given in Para 2, at the time of his death. That according to the complainant all the four policies were covering accident benefits. THE complainant alleged that her deceased husband was murdered and, therefore, his death was on account of accident and, therefore, the complainant was entitled to both the amount of insurance as well as the accident benefits.

THE Insurance Company appears to have paid the basic insurance amount and had also paid accident benefits in two policies and, therefore, the complainant has filed this complaint to recover the accident benefits of Rs. 10,000/- and Rs. 1,00,000/- in policy No. 49653035 and 830004070 respectively and Rs. 7.500/- and Rs. 5,000/- for policy numbers 3 and 4 respectively. We are told that so far policy number 3 and 4 are concerned, the accident benefits of Rs. 7,500/- and Rs. 5,000/- have already been paid and the dispute therefore remained pending only for the said accident benefits of Rs. 10.000/- and Rs. 1,00,000/-. We have been informed by the Insurance Company that the company has decided to make full payment i.e. accident benefit in respect of the remaining two policies of Rs. 10,000/- and Rs. 1,00,000/- and cheque for the amount of Rs. 1,10,000/- is already deposited in the Court to be paid to the complainant Anilaben N. Patel.

We appreciate the action taken by the Insurance Company in clearing the claims of the complainant though the case regarding the murder of the complainant''s husband is pending in the Court.

WE are of the opinion that if the husband of the complainant is murdered, it is very much in the interest of both the parties that the payment was made to the complainant so that she can pull on with the interest of the amount since she is in utmost need of money on account of loss of her husband which is also a tragic event in her life. WE also appreciate the promptness shown by the Insurance Company to agree to make the payment. Mr. Shah, the learned advocate appearing on behalf of the complainant states that his client is satisfied with the amount received and accept the said amount by way of full and final settlement of claims against all the 4 claims. She has already given receipts for the full and final settlement to the Insurance Company. The office will deliver the cheques which are in the name of the complainant to her advocate. We again make it clear that this amount has been paid by the Insurance Company towards full and final settlement of all her claims and the complainant has accepted the same as full and final settlement and no dues remain payable to her. ORDER The complainant is disposed of as settled. With no order as to costs. Complaint disposed of.
