A money recovery suit was filed against the petitioner by Uttarakhand Gramin Bank, Branch Tehri-Garhwal, which was decreed vide judgment dated 25.09.2014. The decree was put to execution and the Executing Court has issued a notice requiring the petitioner to deposit a sum of Rs. 1,38,293/-.

In the present writ petition, petitioner has sought the following relief:-

"a) Issue a writ, order or direction in the nature of Mandamus directing the respondent Bank to accept the total outstanding amount sanctioned to the petitioner as Cash Credit Limit alongwith interest in equal monthly instalments within a period of 3 years."

Since the matter is pending before the Executing Court, therefore, any interference in the matter at this stage would be unwarranted, however, having regard to the facts of the case, the Writ Petition is disposed of with liberty to the petitioner to make request seeking reasonable time for depositing the loan amount before the Executing Court, which shall be considered in accordance with law.
