Alok Mathur, J
Heard Sri Kirti Kar Tripathi, learned counsel for petitioner as well as learned Standing Counsel for respondents.
It has been submitted by learned counsel for petitioner that petitioner has superannuated from the post of Computer from Irrigation Department on 31.03.2024 and till date the pension payment order has not been received by him but all the issues pertaining to his pension were under consideration by the respondents till he was served with an objection dated 08.04.2024 where the Directorate of Pension has raised certain objections with regard to the regularization of the petitioner which has been done counting his previous services.
Learned counsel for petitioner submits that the said objections were noticed in April, 2024 and despite expiry of nearly six months, no orders have been passed either sustaining the objections or rejecting the same and submits that the grievance of the petitioner shall be substantially redressed in case respondents decide the said objections and release the pension pauyment order with regard to the petitioner.
Learned Standing Counsel does not object to the innocuous prayer made by the petitioner and submits that respondent No. 5 is supposed to consider and decide the objections.
Accordingly, the writ petition is disposed of with a liberty to the petitioner to reply to the objections within next two weeks in case a decision has not already been taken with regard to the said objective and respondent No. 5 shall decide the objects within next three weeks thereafter.
Respondent No. 5 is directed to communicate his response to the petitioner as well as respondent No. 6. i.e. Executive Engineer, Minor Irrigation Circle, Lucknow who thereafter shall proceed to prepare the pension payment order of the petitioner forthwith without any delay.
