By way of this contempt petition, the petitioner has alleged willful disobedience of the judgment passed by this Court in CWP No. 2957 of 2020,

titled as Anil Kumar Joshi vs. Union of India and others, dated 02.01.2021, on the ground that the directions passed therein had not been complied with

by the respondents.

Reply to the contempt petition has been filed by the respondents, in which, it stood mentioned that though the respondents intend to comply with the

directions passed by the Court, however, the committee could not be constituted due to COVID-19 pandemic.

Mr. Balram Sharma, learned Assistant Solicitor General of India informs the Court that now a committee has been constituted in terms of the

directions passed by this Court to re-evaluate the suitability of the petitioner.

There is also on record CMP No. 7247 of 2021 filed by the petitioner wherein it has been mentioned on the strength of the documents appended

therewith that though the committee has now been constituted in terms of the judgment passed by this Court but the committee intends to re -evaluate

the performance of the petitioner by also interviewing him which is not in consonance with the directions passed by the Court. Mr. Bhardwaj submits

that the Court may observe that the performance of the petitioner shall be re-evaluated, strictly in terms of the directions passed by the Court, in

judgment dated 02.01.2021 (supra). Ordered accordingly. The committee which has now been constituted by the respondents shall evaluate the

suitability of the petitioner, strictly in terms of the judgment passed by this Court and parameters foreign to the judgment shall not be introduced by the

committee for the said purpose.

With these observations, as the Court is of the view that the directions passed in the judgment passed by this Court referred to above, are in the

process of being complied with, these contempt proceedings are closed. Notice discharged.
