Kanwaljit Singh Ahluwalia, J.—Present petition has been filed u/s 482 Code of Criminal Procedure seeking quashing of FIR No. 69 dated 1.8.2010, registered at Police Station Dayalpura, District Bhatinda, u/s 420 IPC on the ground that the parties have effected compromise. Compromise has been placed on record as Annexure P-2.

FIR in the present case was lodged by Gurpreet Singh. In his statement to the police, he had stated that Anil Kumar @ Bobby accused duped him and made him to part with a sum of Rs. 4.00 lacs. It is stated that now the accused has returned the amount and the parties have decided to resolve their dispute amicably.

Shri Surinder Singh Kaliraman, Advocate, has caused appearance for the complainant and has filed his affidavit. Counsel for the complainant has submitted that the compromise has been arrived at between the parties and he has no objection if the present FIR is quashed.

Shri Mehardeep Singh, State Counsel, on instructions from HC Gurpreet Singh, Economic Offences Wing, Bhatinda has identified the complainant Gurpreet Singh, who is present in Court. Shri Mehardeep Singh has submitted that factum of compromise has been verified by the Investigating Agency and on the basis thereof, a cancellation report shall be submitted in the Court of concerned Area Judicial Magistrate within 15 days from today.

It is not disputed that the offences for which accused are being tried, are compoundable. Therefore, the present petition is disposed of with a direction to the concerned Judicial Magistrate that as and when cancellation report is submitted, within one month thereafter, the same shall be decided in accordance with provisions of law.

Counsel for the complainant has stated that the complainant shall appear before the Court and make a statement that he has no objection if the cancellation report is accepted and proceedings are dropped.
