Judgment
Tejinder Singh Dhindsa, J.—The petitioner, who is working as a Beldar under the Punjab Public Works Department, Irrigation Branch, has approached this Court in terms of filing the instant writ petition impugning the order dated 14.6.2013, whereby he has been transferred from Ranjeet Sagar Dam Project, Shahpur Kandi to Ferozepur Canal Circle, Ferozepur. The solitary submission raised by learned counsel for the petitioner is that the petitioner is a Class-IV employee and belongs to the lower strata and as such submits that the present petition be viewed as a Mercy Petition as the petitioner in the light of the impugned order is sought to be re-located at a distance of about 350 kms.
Having heard learned counsel for the petitioner, this Court is of the considered view that no basis for interference is made out.
It is well settled that transfer is an incidence of service. This Court would interfere in an order of transfer only, if, the same has been passed in violation of any statutory rule, the order has been passed by an authority not vested with the jurisdiction to issue orders of transfer or if the same is vitiated by the mala fides. None of such grounds has been made out in the present writ petition. No merit, petition dismissed.
