Judgment
Jaswant Singh, J.—Prayer is for grant of regular bail u/s 439 Cr.P.C. to the petitioner in case bearing FIR No. 128 dated 7.5.2010 under Sections 379, 411, 420, 465, 468 and 471 of the Indian Penal Code registered with police station Kotwali Faridkot, District Faridkot.
As per allegations, the complainant-owner of the Verna Car lodged an FIR that his car had been stolen and he had suspicion on the present petitioner-accused who at one time was employed as driver on the said car.
It is submitted that petitioner is in custody since 7th of May 2010 and the main witnesses of the prosecution have already been examined and no useful purpose would be served to keep the petitioner in custody.
Learned State counsel on instructions from ASI Jaspal Singh does not refute the contentions that the main witnesses have been examined. He further submits that no other case is pending against the petitioner.
In view of the above, I find no valid ground to keep the petitioner in custody any longer, as such the present petition is allowed and petitioner is directed to be released on bail subject to satisfaction of the CJM/Duty Magistrate Faridkot.
