The respondent No.1 appears for himself, his brother i.e. respondent No.2 and mother i.e. respondent No.3
The petitioner seeks transfer of his civil suit bearing No.277/2004 (new No.613861/2016) from the Court of Ld. ADJ-14, Central District, Tis Hazari Courts, Delhi to any court of competent jurisdiction in Dwarka. He submits that he is a General Power of Attorney of the petitioner, who is his wife and aged about 64 years. It is not disputed that the property in question is situated within the revenue estate of village Daulat Pur, Post Office Najafgarh, New Delhi which falls in the jurisdiction of South-West, Dwarka. Both the parties are also resident of District South-West, Dwarka.
Hence for expediency of justice, Suit No.277/04 (New No.613861/16) pending in the Court of Sh. Chandra Bose, ADJ-14, Central District, Tis Hazari Courts, Delhi, is withdrawn and the same is transferred to the Court of Ld. District Judge, Dwarka, who shall assign the said civil suit to any court of competent jurisdiction under him for disposal in accordance with law.
Parties are directed to appear before the transferee Court on 15.01.2019.
The petition is disposed of accordingly.
