Heard Mr. R. Gurung, learned counsel for the petitioner.
Issue notice.
Mr. A.H. Kharwanlang, learned Addl. Sr. GA is present and accepts notice on behalf of all the respondents, so no further notice is called for.
The learned Addl. Sr. GA to obtain instructions within 3(three) weeks.
Mr. R. Gurung, the learned counsel for the petitioner has submitted that the writ petitioner is due to retire on 31.03.2024, and that pursuant to the order of this Court, on being regularized had since been promoted and also availing the benefits of the promotional post as also the other consequential benefits. However, he submits that by the impugned orders dated 21.07.2023 and 05.09.2023, the date of regularization of the petitioner has been altered, and orders have been directed for recovery of the excess pay drawn, from the writ petitioner.
Considering the fact that the writ petitioner is to retire on 31.03.2024 itself, it is directed that in the interim, no recovery shall be made from her pension, till the next date.
