Judgment

Aggrieved by an order in the anticipatory bail application, the petitioners who are accused Nos.3 and 4 came up. The offence alleged are under
Sections 294(b), 452, 323, 326 read with Section 34 of the Indian Penal Code. Even going by the First Information Report, the alleged offence was
happened subsequent to an alleged Facebook post containing obscene messages against the daughter of one of the accused. Initial provocation for the
alleged incident, even going by the FIS, came from the defacto complainant. As such, it is a case in which the court can exercise its discretion to grant
pre-arrest bail.
Hence, the anticipatory bail granted to the petitioners on executing bond for Rs.10,000/- each with two solvent sureties each for the like sum subject
to the following conditions;
i) The petitioners shall not repeat any such offence in future and shall not make any threat, coercion or inducement to the victim or her near relatives and shall not
tamper with the evidence involved in the case.
ii) The petitioners shall not leave the jurisdiction of the trial court without prior permission.
iii) The petitioners shall appear before the Investigating Officer as and when required.
Application is allowed accordingly.
