Petitioners styling themselves as agriculturist are before this Court seeking indulgence in the matter of demarcation of their land as according to them some parcels of Government land is overlapping their land as a result the revenue authorities intend to maroon the entire standing crop under the pretext of removal of encroachment.

Shri Khot, learned counsel for the State submits that proceedings under Section 248 of MPLR Code has already been initiated and the order has been passed.

In view of aforesaid facts and circumstances, this Court refrains from commenting upon the prayer sought. Suffice it to say that the petitioner is always free to challenge the order passed by the Revenue Authorities under Section 248 of MPLR Code and may file an appeal under Section 44 of MPLRC Code against the order. In case if appeal is filed within 10 days, then the Appellate Authority shall not insist upon the question of limitation and address on merits as well as interim application with promptitude.

With aforesaid, petition is disposed of.
