Judgment
U.C. Maheshwari, J.—Heard on IA No. 9432/13, applicant''s application for amendment in the revision memo. For the reasons stated in it, so also keeping in view that the same has been filed for curing the default raised by the office in the revision memo, is allowed.
The applicant''s counsel is directed to carry out the necessary correction in revision memo during the course of the day.
With the permission of the court, the same has been carried out by him.
Accordingly the same is certified.
At his request he is heard on the question of admission.
This revision has been preferred u/s 23-E of the M.P. Accommodation Control Act 1961, in short "The Act", being aggrieved by the order dated 18.6.2013 passed by the Rent Controlling Authority, District Katni in Revenue Case No. 06/A-90(3)/07-08, whereby allowing the application of respondent filed u/s 23-A of the Act, the order to evict the applicant from the disputed premises has been passed.
Having heard the counsel, keeping in view his arguments, after perusing the impugned order, this revision appears to be arguable, hence the same is admitted for final hearing.
Let notice of this admission as well as IA No. 9426/13, returnable within one month be issued to the respondent.
Necessary steps alongwith requisites of registered post in this regard be taken within seven days, failing which this revision shall stand dismissed automatically without further reference to the Bench.
Apart the aforesaid office is also directed to list this matter for final hearing in accordance with the Scheme and spirit of Section 23-E of the Act within six months positively.
Let the record of the Rent Controlling Authority, Katni be also requisitioned within one month.
As an interim measure till next hearing of this revision subject to compliance of provision of provision 13(1) of the Act with respect of depositing the monthly rent of the disputed accommodation, the impugned order till the extent to evict the applicant from the disputed premises is hereby stayed.
