Heard Mr. Shivanand Bhatt, Advocate for the applicant, Mr. T.C. Agarwal, AGA for the State and Mr. Siddhartha Bhatia, Advocate for the
complainant.
The applicant is in jail having been implicated in Case Crime No. 115 of 2018 under Sections 363, 366A, 376 IPC and Section 3/4 of the Protection
of Children from Sexual Offences Act, registered at P.S. Vikas Nagar, District Dehradun.
The allegation against the applicant is that he kidnapped and enticed the daughter of the complainant. Although the girl is minor, allegedly 15 years
of age, but the applicant is allegedly 19 years of age. The applicant is in jail since 28.02.2018.
Considering the overall evidence, which is presently available before this Court, prima facie, the applicant has been able to make out a case for bail.
The bail application is hereby allowed.
Let the applicant be enlarged on bail in the aforesaid crime on his executing personal bond and two reliable sureties, each of the equal amount to the
satisfaction of the court concerned.
It is made clear that any observations made by this Court are only for the purposes of grant of bail. It shall not be taken into consideration at all in
any other proceedings.
