Vide order dated 02.04.2013, while dismissing the application of the respondents for appointment of a receiver, the appellant was directed to maintain the record of the rent received by him during the pendency of this appeal and to file a statement before this Court every year by 15th of April. The first such account was directed to be filed by 15.04.2014.
An application has been preferred by the respondents with a submission that the appellant has not complied with the order dated 02.04.2013. No reply to the said application was filed by the appellant and on 14.11.2022, learned counsel for the appellant prayed for four weeks’ time to serve notice on the respondents for further proceedings.
A perusal of the record shows that till date no further proceedings as taken by the appellant has been placed on record and neither the compliance of order dated 02.04.2013 has been made.
A last opportunity of three weeks is granted to the appellant to comply with the order dated 02.04.2013. If the same is not complied with in the time, the interim order dated 01.09.2003 shall stand vacated.
The application for early hearing is disposed of.
