The petitioner seeks grant of anticipatory bail in respect of a case registered against him vide FIR No.422 dated 4.9.2012, under Section 135 of the

Electricity Act, 2003, Police Station Anti-Theft, Ludhiana consequent to cancelation of bail, granted to the petitioner on account of his absence in the

trial Court on 21.5.2018.

It has been submitted by learned counsel for the petitioner that his absence on the said day was not intentional but was on account of the fact that his

son had been hospitalized in Dayanand Medical College & Hospital, Ludhiana. Learned counsel in order to hammer forth his aforesaid position has

referred to a bill issued by Dayanand Medical College & Hospital, Ludhiana indicating that Mr. Harsimranjit Singh son of petitioner-Amritpreet Singh

had been admitted in the hospital on 20.5.2018 and was discharged on 24.5.2018.

While issuing notice of motion on 6.8.2018, the petitioner had been directed to appear before the learned trial Court and to furnish bail bonds for his

release on interim bail.

It has been informed by learned State counsel, upon instructions from ASI Kamaljit Singh that pursuant to the aforesaid direction, the petitioner has put

in appearance before the learned trial Court.

Having heard the learned counsel for the petitioner and also the learned State counsel and also bearing in mind the fact that the son of the petitioner

had remained admitted in Dayanand Medical College & Hospital, Ludhiana from 20.5.2018 to 24.5.2018, I find that a lenient view can be taken in the

matter. The petition is as such accepted and interim directions issued vide order dated 6.8.2018 are made absolute subject to the condition that

petitioner keeps on regularly appearing before the learned trial Court.
