Petitioner is a ward of “insured person†as defined under the Employees State Insurance Act, 1948. He appeared in the NEET-2020 exam for

admission to the MBBS Course. He is seeking quashing of the Notice dated 28.09.2020 Annexure P-1 whereby the insured person (IP Quota) seats

reserved in Medical/Dental Colleges established by the Employees State Insurance Corporation (ESIC) for the academic sessions 2020-2021 meant

under the 20% reserved quota for the wards of persons insured under the ESIC, were notified to be withdrawn and directed that the said seats would

be filled up by the Director General Health Services, Government of India as all India Quota Seats.

On the previous dates the counsel for the petitioner had sought time to cite case law, whereby the courts have permitted reservation of seats for

admission in any course for wards of institution/organization concerned.

At the time of hearing, learned Counsel for the petitioner in view of the order dated 15.10.2020 passed by learned Single Judge of the Kerala High

Court, whereby such a claim of similarly situated person has been allowed submits that his clients would thus be entitled to a similar relief in the

medical colleges established by ESIC, thus prays for permission to withdraw the present writ petition.

In view of the above, present writ petition is hereby dismissed as withdrawn.
