Amraram vs Additional District Collector and Another

Govind Mathur, J.—By this petition for writ a challenge is given to the order dated 6.8.2010 passed by learned Additional District Collector, Sirohi rejecting the stay application preferred alongwith appeal pending consideration against the order dated 22.7.2010 passed by the Tehsildar (Land Records) Sheoganj.

The contention of counsel for the petitioner is that if interim order as prayed for by the petitioner in appeal is not granted then the mutation shall be made in favour of the respondents though a dispute regarding title of the land is pending before the Board of Revenue. It is also stated that consequence of rejection of the stay application by the Additional Collector shall be nothing but multiplicity of litigation.

Having considered the argument advanced and looking to the fact that the order impugned relates to rejection of an application for interlocutory order, I am not inclined to interfere with the matter while exercising powers under Articles 226 and 227 of the Constitution of India. However, it is expected from the Additional Collector, Sirohi that he will decide the appeal itself expeditiously as far as possible within a period of two months from the date the petitioner produces a certified copy of this order before the court concerned.

With the observations aforesaid the petition for writ stands disposed of.
