Judgment

Heard on I.A. No.10230 of 2024.
This application has filed on behalf of the appellant seeking permission to travel to British Columbia, Vancouver, Canada to attend convocation ceremony of his son, who is pursuing his studies from the University of British Columbia. It is submitted that the convocation ceremony is scheduled to be held on 30.5.2024 and in support of the aforesaid, documents have been brought on record as Annexures A-1 to A-3 along with the application. It is submitted by learned senior counsel that the appellant is willing to attend the aforesaid convocation ceremony, therefore, he be permitted to travel to the said place.
Learned counsel for the respondent submits that the appellant has been convicted for the offences punishable under Sections 467, 468/120B, 409/120B of the Indian Penal Code, therefore, in order to ensure his return to India, some strict conditions be imposed.
Considering the submissions advanced on behalf of the parties and on perusal of the documents filed along with the application, as undisputedly the convocation ceremony of the son of the appellant is scheduled for 30.5.2024, this Court deems it proper as well as conducive to grant permission to the appellant to attend the said convocation ceremony.
Accordingly, the application is allowed. The appellant is permitted to travel to British Columbia, Vancouver, Canada to attend convocation ceremony of his son with direction that the appellant shall return to India positively by 20th June, 2024 and shall also intimate the Registry of this Court in that regard.
List in the week commencing 8.7.2024 awaiting proposed report regarding arrival of the appellant to India.
