Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 22.11.2019 in connection with Baidyanathapur P.S. Case No.263 of 2019 corresponding to G.R. Case No.15 of 2019 pending in the Court of learned Presiding Officer, O.P.I.D. Court, Berhampur for the alleged commission of offence under Sections 120-B/467/468/471/406/420 of IPC read with Section 6 of Prize Chits and Money Circulation Schemes (Banning) Act, 1978 and Section 6 of the OPID Act, 2011.

Petitioner’s earlier applications for bail were rejected by this Court. It is submitted that in the meantime some witnesses have been examined. The last witness was examined on 11.08.2022 and thereafter, the trial has not progresses.

Considering the above fact of slow progress of trial, while not being inclined to grant regular bail to the petitioner, the BLAPL is disposed of directing the Court below to release the petitioner on interim bail for a period of four months.

After expiry of the aforesaid period of four months, the petitioner shall surrender before the Court in seisin over the matter, failing which appropriate warrant may be issued for his production. Further, the Court below shall make efforts to conclude the trial as early as possible, preferably within a period of six months.

BLAPL is accordingly disposed of.
