Petitioner made a complaint against certain persons to S.I.T. Land. Inspector (S.I.T. Land) has submitted a report on 29.08.2019, which is annexure no. 9 to the writ petition.

Perusal of the said report indicates that Inspector (S.I.T. Land) has closed the investigation on account of pendency of two writ petitions before this Court. Thus, feeling aggrieved, petitioner filed this writ petition, seeking following relief:-

(i) Issue a writ, order in the nature of mandamus directing the Respondent no. 1 to investigate further in the matter and produce the report before the revenue authority.

(ii) Issue a writ, order in the nature of certiorari to quash the impugned order dated 29.08.2019.

Petitioner's complaint is regarding encroachment over the land purchased by her and sale of land by certain persons more than their total land holding. Inspector (S.I.T. Land) was not justified in closing the enquiry on account of pendency of writ petitions before this Court against the orders passed by Consolidation Authorities, as the issue raised in the complaint could have been gone into, even during pendency of the writ petitions.

Accordingly, writ petition is disposed of with a direction to the respondent to do the needful to ensure that the issues raised in petitioner's complaint are investigated. This Court hopes and expects that such investigation would be concluded within nine months from the date of production of certified copy of this order before the respondent.
