This petition coming on for hearing this day, the Court passed the following:
TRIAL COURT CASE NO.
314/2021, decided on 22.07.2021, by learned Special Judge (III) Mandi, District Mandi, H.P.
The petitioner, aggrieved by dismissal of application under Section 457 Cr.P.C., read with Section 60(3) of NDPS Act filed for release of vehicle, has come up before this Court against the impugned order passed by learned Special Judge,(III), Mandi.
Mr. Nand Lal Thakur, learned Additional Advocate General has filed the status report. The Investigator is also present. Learned Additional Advocate General, on instructions, submits that the vehicle in quiestion is registered in the name of one Sanjay Kumar and the invesitgator has taken into possesson some documents of the vehicle. Since the present petition is filed by Amita Devi, who claims to have purchased the vehicle from Sanjay Kumar, by way of affidavit, as such the police official shall return the original decuments of the vehicle to Sanjay Kumar on his application. After that it shall be permissible for Amita Devi and Sanjay Kumar to apply the concerned authority for transfer of the ownership of the vehicle and transfer of its insurance, if any, and other documents before the concerned authority. It is subject to the condition that once the transfer is done, then they shall deposit the freshly endorsed certificates with investigating officer. After that there shall be a liberty to the newly registered owner to file an applciation before this Court for release of the vehicle.
With the aforesaid liberty the present petition is closed. Filing of the present petition will not come in the way of the petitioner to file the fresh petition.
