Prayer made in the present petition is for issuance of direction to respondent No.1 to forward the case of the petitioner to the medical board, for the purpose of scrutinizing the cases of those candidates who could not appear for PST due to physical difficulty/disability, and further allow him to appear provisionally for physical measurement test as also scrutiny of documents as per notice dated 30.12.2021 (Annexure P-11).
As is apparent from the facts of the case, the petitioner had cleared the written examination, whereafter the mandatory Physical Screening Test (PST) was conducted, which was a part of the selection process, as per clause 2.3 of the advertisement dated 30.12.2020 (Annexure P-1). A notice dated 24.12.2021, R-2/1 was issued, granting opportunity to all the candidates who could not take the test on the scheduled date due to some valid reason, and were asked to appear before the Medical Board constituted in the office of Civil Surgeon, Panchkula. An apt reference in this regard can be made to the relevant para of the reply dated 12.03.2025, filed on behalf of respondent No.1-Commission, which reads thus:
"5.That the petitioner also contended in para 04 of the present writ petition that the petitioner was absent in the Physical. Screening Test (PST) as suffered from injury at the time of Practice on 13.12.2021. In this regard it is submitted that the petitioner was called for the PST on 19.12.2021. Whereas the other candidates who were not able to participate in PST due to some valid reasons they submitted their representation to the Commission and on such representations the Commission had taken the step to allow the injured candidates provisionally for MT after their medical examination by Medical Board at Civil Hospital, Panchkula vide letter dated 24.12.2022. The Medical Board examined the physical condition of the candidate and found unfit for PST, on basis of above such report the Respondent-Commission has issued the Admit card of PMT and Scrutiny of Documents to the candidates. That the public notice dated 24.12.2021 is annexed as annexure R-2/1 had been issued by the respondent commission in the public domain but the petitioner himself on his own remained silent and did not approach the medical board during the relevant period reason best known to the petitioner. Further as per the public notice dated 24.12.2021, the candidate who did not appear before the Medical board will treated as absent.
Further as per the public noticed dated 24.12.2021, it was clearly mentioned that the candidate should appear directly before the Medical board at Civil Hospital, Panchkula and there was no requirement to approach the Commission. " (emphasis supplied)
The fact remains, that the medical examination of the candidates continued for 3 days but still the petitioner failed to participate in the rescheduled PST, as is evident from Annexures R-1 to R-3, appended with the reply of Civil Surgeon, Panchkula, dated 30.03.2022.
There was neither any counter to the above, nor learned counsel for the petitioner, despite best efforts, was able to, during the course of hearing, dispel the same or carve out a case for interference in his favor. Moreover, the recruitment process already stands completed.
In view of the above, the present petition being sans merit, is hereby dismissed.
