Heard learned counsel for the parties.
The present appeal has been filed against the order dated 20.03.2013 passed by the learned Additional District Judge No.1, Jodhpur Metropolitan, Jodhpur, whereby the application seeking temporary injunction preferred by the plaintiff-respondent No.1 under Order 39 Rule 1 & 2 read with Section 151 CPC has been partly allowed.
Learned counsel for the parties are in agreement that during the pendency of the appeal before this Court, the learned trial court has proceeded with the matter and now the suit is posted for final arguments on 12.12.2023. Learned counsel, therefore, very fairly submit that the appeal may be disposed of directing the learned trial court to decide the pending suit expeditiously.
Considering the limited submissions made before this Court, the present appeal is disposed of with a direction to the learned trial court to decide the pending civil suit expeditiously, preferably within a period two months from the date of receipt of the certified copy of this order strictly in accordance with law.
It is made clear that no adjournments shall be granted by the learned trial court to any of the parties, unless it is unavoidable.
