This petition, seeking review of the judgment of this Court dated 13.07.2022 in W.P. (C)No.24037/2016, has been filed by the writ petitioner, saying that, at the time when it was delivered, she was not aware that the respondent– Society was registering profits for the last several years. She asserted that it is solely on account of the financial crisis projected by the Society that this Court had fixed six months time for disbursement of her retiral benefits; and that interest was also so denied.
Even when I hear Sri.C.P.Peethambaran – learned counsel for the petitioner, on the afore lines, the fact remains that this Court did not intend to grant interest to the petitioner in the writ petition, filed under Article 226 of the Constitution of India, but thought it better to order that if the amounts are not paid within a time frame, it will carry interest; and if it is so paid, then the petitioner can invoke other alternative remedies.
However, since it is now stated before me that the Society is actually in profit, I asked Sri.P.P.Jacob - its learned Standing Counsel, about it, to which, he replied that his client is willing to pay the amounts within a period of one month from today.
In the afore circumstances, I allow this Review Petition, modifying the judgment in question to the limited extent of ordering that the time frame fixed therein will stand altered to be one month from today.
In all other respects, the judgment will remain unaltered.
