This contempt petition is preferred under Article 215 of Constitution of India read with Section 10 and 12 of Contempt of Court Act for non-compliance of the order dated 15.05.2017 passed by this Court in Writ Petition No.4204/2005.

Learned counsel for the petitioner submitted that the act of the respondents is not only deliberate act of contempt but it is a proved contempt because when contempt was initiated against them bearing Contempt Petition No.138/2012, they filed the compliance report. Thereafter, in Contempt Petition No.2072/2017, they again submitted the compliance report and now when the contempt was purged on the basis of said compliance, the respondent have issued notices to withdraw the said compliance. Thus, there is absolutely nothing on record to indicate that the direction has ever been complied with. He further submitted that the order which has been submitted before this Court for showing the compliance and forgetting the contempt purged cannot be permitted to stand. Therefore, prayed for punishing the respondents for contempt.

Annexure-A is the order dated 13.03.2007 passed in Writ Petition No.5306/2005, wherein it was ordered as under :-

Consequently, the petition of the petitioner is disposed of with the following directions :-

(i) That, the orders impugned, Annexure P-1 dated 14-11-2005, Annexure P-1/A dated 24-11-2004, Annexure P-8 dated 29-7-2002 and Annexure R-17 dated 7-6-2002 with regard to cancellation of taking over of the school by the respondents are hereby quashed;

(ii) The respondent-State is at liberty to pass appropriate orders with regard to absorption of the staff members and teachers of the school in pursuance to the directions issued by the Government as per the circular of the State Government dated 11-11-2003 and 21st March, 2002 and other circulars issued by the State Government in this regard, as per law;

(iii) Necessary committee be constituted by the Government to this effect and the orders of absorption of the staff members and teachers be passed within a period of six months from the date of receipt of a certified copy of this order.

(iv) Staff members and teachers appointed as per the orders passed by the Chief Municipal Officer including the petitioner will be permitted to continue in service upto the period when the Government will pass the orders of absorption in pursuance to the aforesaid order and the salary of the petitioner and other staff members and teachers be paid by the Government accordingly. Arrears of salary be also paid by respondents No.1 and 2.

From the above quoted direction, it is evident that the direction has been issued that the absorbed teaching staff shall be given the status of contractual teacher and they will be absorbed in the cadre of Adhyapak only on their getting requisite qualification. It was also directed that the recovery be also made from those persons who have been paid the differences.

Learned counsel for the petitioner submitted that the act of the respondents is resulting to anarchism because when the issue comes in punishment of contempt, the orders are shown to be complied with. The status of Samvida could not be assigned as the school has been made over under Government and the status of the Government teacher has to be assigned, as such qualification of B.Ed. and D.Ed. is not existing being a teacher in the year 2002, which is a relevant date. The compliance has been submitted by the Principal Secretary while the present order has been passed by the Commissioner and upon being notice the Principal Secretary has not issued any such order to withdraw the said order dated 09.11.2018 which is clear proof of involvement in contempt.

Per contra, learned counsel for the respondent No.4 submitted that with regard to the present petitioner- Ambika Shiksha Prasar Samiti, a specific order was passed by the Office of District Panchayat, Sheopur bearing No./Estt/2018/120, Sheopur dated 07.01.2019. The said order runs as under :-

"विषय:- श्री अम्बिका उ0मा0वि0 इकलोद, विजयपुर के अप्रशिक्षित (बी0एड0/डी0एड0) शैक्षणिक संवर्ग के कर्मचारियों के सम्बंध में।

संदर्भ:- लोक  शिक्षण  संचालनालय  म0प्र0  भोपाल  का  पत्र क्रमांक-अनुदान/ज/63/2015/1711 दिनांक 09.11.2018 एवं पत्र क्रमांक/अनुदान/ज/63/2015/3 भोपाल दिनांक- 02.01.2019 के क्रम में।

उपरेाक्त विषयान्तर्गत लेख है कि संदर्भित पत्र के द्वारा श्री अम्बिका उ0मा0वि0 इकलोद, विजयपुर, जिला श्योपुर को निकायधीन करते हुये कार्यरत कर्मचारियों को अध्यापक संवर्ग में संविलियन किया गया। वरिष्ठ कार्यालय द्वारा अप्रशिक्षित संविदा शाला शिक्षकों को अध्यापक संवर्ग में संविलियन त्रुटिपूर्ण बताते हुये ऐसे अप्रशिक्षित संविदा शाला शिक्षकों को सुनवाई का समुचित अवसर देते हुये, सम्बंधित की नियुक्ति यथावत संविदा शाला शिक्षक के सुसंगत पद पर तब तक मान्य की जाये, जब तक कि वे शिक्षण प्रशिक्षण योग्यता अर्जित नहीं कर लेते। शिक्षण प्रशिक्षण योग्यता प्राप्त करने के उपरांत शासन आदेश दिनांक 15.02.2018 के अनुसार अध्यापक संवर्ग में सुसंगत पद एवं वेतनमान पर नियुक्ति की कार्यवाही किये जाने हेतु निर्देशित किया गया है।

उक्त निर्देश के क्रम में कार्यालय जिला पंचायत श्योपुर के द्वारा दिनांक 24.12.2018 को सुनवाई हेतु सूचना पत्र जारी करते हुये दिनांक 04.01.2019 को प्रातः 11 .00 बजे स्थान जिला पंचायत श्योपुर में अद्योहस्ताक्षरकर्ता के समक्ष उपस्थित होकर इस संबंध में अपना प्रतिवाद/अभिलेख प्रस्तुत किये जाने का समुचित अवसर प्रदाय किया गया । तद्उपरांत दिनांक 04.01.2019 को विद्यालय में कार्यरत शैक्षणिक संवर्ग के कर्मचारी उपस्थित हुये तथा उक्त सम्बंध में अपना प्रतिवाद प्रस्तुत किया गया जिसमें पूर्व में सम्बंधितों को अध्यापक संवर्ग में माननीय न्यायालय के निर्णय के अधीन संविलियन किये जाने का उल्लेख करते हुये वर्तमान में लम्बित अवमानना प्रकरण क्रमांक 3556/2018 के परिप्रेक्ष्य में जारी किये गये नोटिस को निरस्त करने का निवेदन किया गया है।

अतः उक्त विद्यालय में कार्यरत समस्त ऐसे कर्मचारी (संविदा शाला शिक्षक वर्ग-1 एवं 2) जो वर्तमान में अप्रशिक्षित है। ऐसे समस्त अप्रशिक्षित अध्यापक संवर्ग के सम्बंध में जारी संविलियन आदेश क्रमांक/शिक्षा/2018/761 श्योपुर दिनंाक 24.02.2018 में अप्रशिक्षित कर्मचारियों के नाम के सम्मुुख काॅलम नं0 7 में अंकित वरिष्ठ अध्यापक/अध्यापक के स्थान पर संविदा शाला शिक्षक वर्ग-1 एवं वर्ग-2 अंकित किया जाता है तथा इनकी नियुक्ति संविदा शाला शिक्षक वर्ग-1 एवं वर्ग-2 के पद पर की जाती है, इन्हें संविदा शाला शिक्षक का मानदेय ही प्रदाय किया जावेगा तथा इनको हुये अधिक भुगतान की नियमानुसार वसूली की जावे।''

As the required minimum qualification was not possessed by the present petitioner, recovery orders were made against him. It is settled principle of law that minimum qualification which is required for a specific post always remains mandatory unless any exceptional clause is there.

In the present case, the petitioner has not shown any exceptional clause, under which he may get any benefit of relaxation of minimum qualification. The petitioner was given sufficient time for getting the minimum qualification, despite he was unable to get the minimum qualification. Hence, only on the basis of contempt petition filed by him, the petitioner cannot get the desired relief.

In the above facts and circumstances of the case, this petition has no force and is dismissed. Rule nisi is discharged.
