Judgment

The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in custody in connection with F.I.R. No.87/2023 dated 01.03.2023, registered at Police Station Kotwali Ganganagar, District Sri Ganganagar, for the offences under Sections 342, 323, 377 and 34 of IPC and Section 3/4 and 5/6 of the POCSO Act.
Learned counsel representing the petitioner submits that the petitioner herein has been falsely roped in this case. In this regard, he further submits that the FIR in which the allegations of unnatural sex has been levelled is apparently showing that the allegations are false. He, thus, urged that the petitioner deserves to be released on bail.
Per contra, learned GA-cum-AAG vehemently opposes the submissions advanced on behalf of the petitioner and submits that the said offence has been committed with the boy, who is aged 17 years and thus, on that count, the petitioner does not deserve indulgence of bail in this case.
Heard learned counsel representing the petitioner and learned GA-cum-AAG as well as perused the material available on record.
Having regard to the entirety of facts and circumstances of the case as available on record and without commenting on the merits/demerits of the case, this Court is not inclined to enlarge the petitioner on bail at this stage.
Accordingly, the instant application for bail filed under Section 439 Cr.P.C. is dismissed.
