Judgment
Mr. Chakravarty, learned advocate appears onn behalf of appellant-husbaand and wants to proceed with hearing off the appeal, ex parte against respondent-wife on sufficiency of servvice both by refusal to acceppt postal service as well as direction for substituted service carried out. He submits, his client is aggrieved by judgment dated 7th Februaary, 2023 of the Family Court dismissing his petition for dissolution of the marriage.
Appellant is entitled to be heard in the appeaal, ex parte against responddent-wife. On query from Court Mr. Chakravarty submits, Mr. Bijay Kumar Pradhan, learned advocate of Balasore Bar Association conducted the case for respondent-wife in the Family Court.
We reprooduce below paragraph 1 from our order dated 12th January, 2024.
“Mr. Chakravarty, learned addvocate appears on behalf of appellant-husband and submmits, his client is aggrieved by judgment dated 7th Febbruary, 2023 made by the family Court dismissing his client’s petition for dissolution of the marriage and directing ₹10,000/- per month as maintenance for respoondent-wife and ₹4,000/- per month for the minor soon. He demonstrates from orders made that there wass good service on respondent-wife refusing to accept the postal article annd thereafter direction for substituted service. His clientt had duly put in requisites and there wass paper publicatioon.”
Registry is directed to communicate website copy off this order through Registtrar, Civil Court, Balasore to Mr. Biijay Kumar Pradhan, learned advocate of Balasore Bar Association and lay note confirming the communication. It is made clear, we will proceed with hearing of the appeal on adjourned date, irrespective of representation/ appearance by respondent-wife.
