Issue notice. Mr. Rahul Gathania, Advocate, accepts notice on behalf of the respondent.

The petitioner is aggrieved by order dated 05.06.2025, in terms whereof, the right of the petitioner to file written statement stands struck of.

Having heard learned counsel for the parties and having perused the impugned order, though, this Court prima facie does not find any infirmity therein as enough indulgence was given to the petitioner to file the written statement.

However, taking into consideration the peculiar facts of this case i.e., that the Civil Suit itself was dismissed on 01.05.2018 and thereafter it was resorted only on 22.04.2025, one indulgence is given to the petitioner to file written statement subject to payment of cost of Rs.20,000/- to the respondent/plaintiff. The case is stated to be listed on 22.11.2025. Learned Court is called upon to grant three weeks’ time to the petitioner to file written statement. This of course will be subject to his paying cost of Rs.20,000/- to the plaintiff. If the cost is paid and written statement is filed within three weeks from 22.11.2025, then, the same be taken on record. However, if needful is n t d ne within three weeks from 22.11.2025, then, this order will loose its efficacy.
