Judgment
Raghvendra S. Chauhan, J.—The petitioners have approached this Court for quashing F.I.R. No. 317/2012 registered at Police Station, Sadar, Nasirabad, District Ajmer for the offences under Secs. 341, 323 and 432 I.P.C. and for the offence under Secs. 3(1)(v)(x) of SC/ST [Prevention of Atrocities] Act. Learned counsel for the petitioners pleads that both the parties have compromised. A copy of the compromise has been submitted before this Court as Annexure-2. In the light of the compromise, learned counsel pleads that no fruitful purpose would be served in continuing the investigation. Therefore, the F.I.R., should be quashed.
This Court directs the petitioners to appear before the Investigating Officer of the concerned F.I.R., along with the complainant and to produce the compromise entered between the parties before the Investigating Officer.
The Investigating Officer is directed to consider the existence of the compromise, and then to decide whether further investigation is required or not, and whether charge-sheet should be filed or not,
Since the parties seem to have compromised, the Investigating Officer is directed not to arrest or to harass the petitioners, when they appear before him.
With these directions, the petition stands disposed of. Consequent upon disposal of the main petition, the stay application, filed therewith, does not survive; the same is also disposed of.
