Present Civil Writ Petition has been filed under Article 226/227 of the Constitution of India praying for issuance of a writ in the nature of mandamus directing the respondent No. 2 to reallocate the seat of the petitioner to free seat on the basis of first preference under the C.F.F. Category (Children and grand children of Freedom Fighters) upto 2% of seat from the reserve category.
Learned State counsel has submitted that the present matter pertains to year 1998 and the present petition, in all probability, has been rendered infructuous.
As per report of the registry, counsel for the petitioner has been informed but none has appeared on behalf of the petitioner.
In view of the above facts and circumstances, present Civil Writ Petition is dismissed for non-prosecution at this stage. Liberty is granted to the petitioner to move an application for revival of the present case, in case, any cause of action survives in the same.
Registry is directed to send the copy of the present order to the petitioner at the addresses mentioned in the memo of parties.
