By means of present writ petition, petitioner has put to challenge the FIR No.0069 of 2025 dated 01.03.2025, under Section 137(2) of BNS, 2023, registered with Police Station Jhabrera, District Haridwar.
When the matter was called as fresh on admission, learned counsel for the petitioner strenuously argued that in the statement recorded under Section 183 of BNSS, 2023 (Section 164 of Cr.P.C.), nothing has been stated against the petitioner, therefore, he requested this Court to sent for those statement from the respondent/State.
Today, learned State Counsel, on instructions, submits that the statement recorded under Section 183 of BNSS, 2023 is received and the same is passed on to this Court.
After perusal of the statement of victim recorded under Section 183 of BNSS, 2023, it is clear that she has roped the petitioner in the alleged crime.
Having gone through the statement of victim recorded under Section 183 of BNSS, 2023 as well as having gone through the FIR, this Court is of the view that no protection is warranted at this stage to the petitioner. He is involved in a serious and heinous crime. Accordingly, the writ petition is dismissed.
Pending application, if any, stands disposed of accordingly.
