This is a petition under Article 226 /227 of the Constitution

of India seeking a writ in the nature of mandamus directing respondents

No. 1 and 2, i.e. Punjab State Power Corporation Limited and Assistant

Executive Engineer, PSPCL, respectively, to provide provisional

electric meter to Flat No. 17, Royal Apartment, Ludhiana.

As a matter of fact, the meter connection provided to the

owner of the building is for domestic purpose and since the petitioner

seeks to use the premises for commercial purposes, he would be

required to submit the following documents:-

i) To provide the consent letter from respondent No. 3 i.e. the owner of the meter.

ii) Submission of NOC issued by concerned local authority.

iii) Test Report, load etc.

iv) A & A Form i.e. Application & Agreement Form.

It has been undertaken on behalf of the respondents that

provisional meter connection, can be released, only after the compliance

of the above said conditions.

Learned counsel for the petitioner, at this stage, has

submitted that the condition of consent letter from the owner, cannot be

complied with, as there is a dispute. In this context, it will be open to

the petitioner to seek an exemption and in case rules permit, such

exemption will be granted. Otherwise the petitioner will be entitled to

enforce the legal rights, in accordance with law.
