Proposed revisionist-accused Aman Singh was convicted by the Trial Court under Section 138 of the Negotiable Instruments Act, 1881 and was sentenced to undergo simple imprisonment for a period of one year along with a fine of Rs. 1,90,000/-. An Appeal (Criminal Appeal No. 78 of 2022) was filed by him. The said Appeal has been dismissed vide judgment dated 01.04.2023, passed by learned Additional Sessions Judge, Kotdwar, District Pauri Garhwal.

Heard Mr. Piyush Garg, learned counsel for the revisionist, Mr. Pratiroop Pandey, learned A.G.A. along with Mr. Rakesh Negi, learned Brief Holder for the State and Mr. D.S. Mehta, learned counsel for the respondent no. 2.

Heard on the Bail Application (IA No. 02 of 2023).

Mr. Piyush Garg, Advocate, has submitted that the revisionist is in judicial custody since 03.08.2023. He was on bail during the trial and appeal, and, the conditions of bail were never misused by him.

Considering the facts and circumstances of the case, this Court is inclined to grant bail to the revisionist-Aman Singh.

Let the revisionist be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the Trial Court.

On the request of both the parties, the present matter is referred to the National Lok Adalat, which is scheduled to be held on 09.12.2023.
