The learned Government Pleader submits that the competent authority to certify economically weaker sections is the third respondent, and the third

respondent is yet to take a final decision on the application preferred by the petitioner. It was pointed out by the learned Government Pleader that

orders will be passed on the application by the third respondent within two days. It was clarified by the learned Government Pleader that Ext.P4 is

only the report made by the fourth respondent to the third respondent.

In the light of the submissions made by the learned Government Pleader, I deem it appropriate to pass an interim order directing the third

respondent to afford the petitioner an opportunity of hearing before final orders are passed on the application preferred by him. Ordered accordingly.

The third respondent shall certainly take into account Ext.P1 certificate earlier issued by him, while passing orders on the application preferred by the

petitioner.

The petitioner shall produce this order for compliance before the third respondent at the earliest.
