Judgment

Notice upon O.P. No.2 is reported to have been served.
Heard Mrs. P. Chakraborty, learned legal aid counsel appearing for the appellant-petitioners.
Ms. A. Debbarma, learned counsel appearing for the O.P. No.1 has submitted that she will not file any objection for O.P. No.1.
Mrs. Chakraborty, learned legal aid counsel has submitted that there has been delay of 123 days in preferring the connected appeal and the grounds of such delay as stated are that after receipt of the copies of the impugned judgment and decree, the petitioners had applied for legal assistance under the Legal Aid Scheme before the High Court Legal Services Committee and after processing of the file ultimately, Mrs. Chakraborty, learned counsel was engaged as legal aid counsel to represent the appellant-petitioners in the connected appeal and thereafter, she filed the appeal by preparing a memo of appeal.
Ms. Debbarma, learned counsel did not oppose the prayer for condonation and submits that the main appeal may be taken up for admission hearing.
Considered the submission.
The grounds as stated hereinabove are found satisfactory and accordingly, the delay is condoned.
In view of the above, this interlocutory application stands allowed and disposed of.
