Judgment
Heard Ld. Sr. Counsel for the Appellant, he submits that after approval of the Resolution Plan, Ld. Adjudicating Authority has directed to satisfy the decree holders, which is against the IBC.
Issue Notice on Appeal as well as I.A. No. 1749 of 2021.
Ld. Counsel appearing for Respondent Nos. 1 to 3 & 4 accept notice and they seek and are granted two weeks' time to file Reply Affidavit and also Reply of I.A. No. 1749 of 2021.
Rejoinder, if any, may be filed within one week thereafter.
Ld. Counsel Mr. Abhishek Anand submits that the Roma Unicon Designex Consortium was necessary party before the Adjudicating Authority, therefore, the same may be impleaded as Respondent.
Ld. Counsel for the Appellant makes the submission that the Appellant may be permitted to implead the Roma Unicon Designex Consortium as Respondent No. 5. He is permitted to do so and directed to make necessary correction in the memo of Appeal.
Ld. Counsel Mr. Abhishek Anand for the Respondent No. 5 accepts notice and he is directed to file Reply affidavit within three weeks. The Appellant Counsel may provide the appeal paper book to the Respondent No. 5 within a week.
Let the matter be fixed 'For Admission (After Notice)' on 06th October, 2021.
