PRESIDENT-Heard learned Counsels for the parties. The short point involved in the present litigation is about transfer of telephone. The complainant was residing at Delhi while in service there. The learned Counsel for the O.P. submits that as per the extent rule the original receipt issued to the subscriber on surrendering the telephone at Delhi is required to be produced for the purpose of shifting the telephone from Delhi to Calcutta and the reconnection thereof at the present address of the complainant. The learned Counsel for the O.P. submits that the complainant having failed to produce the said certificate in original, the connection could not be given. He submits further that the Department is agreeable to provide new connection to the complainant at his calcutta address provided this certificate is produced in original. This being the position we think it necessary to direct the O.P. to give new connection to the complainant at his new address upon submitting the original receipt of surrender granted by the Delhi Office of the Department. The complainant would approach the Department within two weeks from this date and observe all usual formalities in obtaining connection at his new address and the Department would act strictly in accordance with the Circular in this regard.

THE connection is to be given within a period of two weeks after the complainant approaches the Department and complies with all the formalities. THE learned Counsel for the complainant prays for compensation or at least some cost to the complainant. THE prayer for cost is opposed by the learned Counsel for the O.P. He submits that if any body is to be blamed, it is the complainant alone because he has not submitted the original surrendering receipt to the Department. Be that as it may be we do not think it necessary to award any cost or compensation in favour of the complainant. With this observation,the case be disposed of. Complaint disposed of.
