The appellant has challenged the legality of the order dated 21.12.2020, passed by the learned Additional District Judge (Commercial Court), Dehradun, whereby the learned court had permitted the respondent to remove the goods lying in the premises owned by the appellant/respondent.
Both the learned counsel for the parties are ad idem that the parties have settled their dispute outside the Court. A copy of the settlement agreement reached by the parties has been submitted before this Court for its perusal. The same shall be taken on record.
According to the terms of the settlement, the plaintiff will hand over a Demand Draft, bearing No. 008020, dated 26.03.2021, drawn on HDFC Bank, for an amount of Rs. 12,00,000/- (Rupees twelve lacs only) in favour of the appellant once the goods are taken out of the subject property. The said amount shall be exclusive of security deposited of Rs. 3,00,000/- (Rupees three lac) lying deposited with the appellant.
Since, the parties have settled their dispute amicably, no further order needs to be passed by this Court.
Accordingly, the present appeal stands disposed of in terms of the settlement arrived at between the parties.
