Judgment

Petitioner/convict (CTP No.4423), who has been convicted for the offence punishable under Section 302 of the Indian Penal Code in S.C.No.324/2017 and is undergoing incarceration, is before this Court seeking the following reliefs:

a. “Direct the Respondent No.2 to release the petitioner ALLASHAH CTP-4423 on emergency parole for a period of 15 days to attend and solemnize the marriage of his son which is going to be held on 16/10/2026. Hence the presence of the convict is indispensable for performing the customary family rituals and discharge his responsibilities associated with the marriage ceremony.

b. Pass any other order(s) which this court may deem fit and proper under the facts and circumstances of the case, in the interest of justice.”

Learned counsel for the petitioner appearing through video conference, submits that the wedding of the petitioner’s son is scheduled to be held on 16.10.2026. He submits that the petitioner has already undergone incarceration for 9 years, 1 month and 4 days and that there are no adverse remarks against him.

The petitioner submitted the application for parole on 03.10.2026 and that no order has been passed on the said application till date. Hence, the petition.

The learned HCGP taking notice for the respondent submits that the application was submitted only on 03.10.2026 and without even providing sufficient time to the Authorities for consideration of the application, the petitioner has rushed to this court.

However, he submits that given some time on verification of the veracity and genuineness of the claim made regarding marriage of petitioner’s son, an appropriate order in accordance with law will be passed.

Submission is placed on record.

In view of the aforesaid submission, the petition is disposed of with following directions:

ORDER

a. Respondent No.2 shall verify the reasons assigned seeking grant of parole and thereafter consider the request for grant of parole to convict (CTP No.4423) for a period of 10 days from the date of his release.

b. Such consideration shall be made and necessary order be passed within five days from today.

c. During the said period of parole, the convict (CTP No.4423) shall appear before the jurisdictional police once in a week and shall return to the prison on or before expiry of the period of parole.

d. Convict (CTP No. 4423) shall not involve himself in any illegal or criminal activities.

e. In the event of breach of any of the conditions, the convict (CTP No. 4423) shall immediately be secured and sent back to prison.

f. The Jurisdictional police shall ensure that, on expiry of the parole period, the convict (CTP No.4423) is sent back to prison.

g. Registry is directed to communicate this order to the concerned authorities for necessary compliance.
