The present writ petition has been filed seeking directions to the respondent-Election Commission of India (“ECI”) to register the name of the petitioner as a political party before the ECI as the petitioner wants to setup its candidate in the forthcoming General Legislative Assembly Election of Assam State, which is going to be scheduled in the next year of 2026.

As per the facts on record, it is the case of the petitioner that the petitioner submitted an application on 06th March, 2025, under Section 29-A of the Representation of Peoples Act, 1951, alongwith three proposed alternative names also, and submitted all other required documents before the ECI to register political party in the name of „All Party Hills Leader Conference‟, as per the guidelines of the ECI.

Thereafter, on 07th March, 2025, an acknowledgement letter has also been sent by the respondent office to the petitioner. After receiving the acknowledgement letter, the petitioner regularly telephonically contacted in the office of the respondent. However, no response has been received as yet.

It is submitted that the petitioner had filed an application for submission of additional documents as per checklist item nos. 28 and 32 on 25th  July, 2025 and the same was duly acknowledged by the ECI.

The petitioner had also requested the respondent to approve the name of the political party as four (4) months had already passed from date of filing of the application under Section 29-A of the Representation of People Act, 1951.

It is the case of the petitioner that the ECI has issued a circular for submission of application under Para 10B of the Election Symbols (Reservation & Allotment) Order, 1968 for allotment of common symbol in the state of Assam from 21st November, 2025. However, the respondent has neither approved the proposed name „All Party Hills Leader Conference‟, nor registered the petitioner as political party in ECI till date.

Thus, the present writ petition has been filed with prayer for directions to the respondent to approve the proposed name, i.e., „All Party Hills Leader Conference‟ or the alternate proposed names of the political party.

Issue notice. Notice is accepted by learned counsel appearing for the respondent, who submits that a letter dated 14th November, 2025 has been issued to the petitioner, pointing to certain deficiencies. The said letter dated 14th November, 2025, reads as under:

By referring to the aforesaid letter, learned counsel appearing for the respondent submits that all requisite documents, as per the guidelines and directions of the ECI have still not been filed by the petitioner.

At this stage, learned counsel appearing for the petitioner submits that all the other documents which are yet to be filed shall be filed, within a period of one week from today.

Accordingly, it is directed that the petitioner shall file all the requisite documents in terms of the guidelines and directions of the ECI, within a period of one week from today.

Upon the petitioner removing the discrepancies as raised in the order dated 14th November, 2025, the respondent ECI shall proceed to consider approval of one of the proposed names of the political party, and register the proposed political party.

Let the needful be done by the ECI, within a period of eight weeks, from today.

With the aforesaid directions, the present writ petition, along with the pending application, is accordingly disposed of.
