The present writ appeal has been filed by the All India Council for Technical Education (AICTE) a statutory body constituted under the provisions

of AICTE Act, 1987 being aggrieved by the order dated 30.07.2020 passed by the learned Single Judge in Writ Petition No.280/2020 (Sri Ananthu

K.M. v. The State of Karnataka and others).

The learned Single Judge has allowed the writ petition in the matter of grant of AICTE pay scale to the petitioner therein keeping in view the

judgment delivered in the case of Sri M.L.Dwarkanath and Others v. The State of Karnataka and others in W.P.Nos.9079-9082/2018 decided

on 18.02.2019. It has also been brought to the notice of this Court that the judgment delivered in the Dwarkanath’s case has already been

complied with.

Learned counsel appearing for the AICTE has argued before this Court that the AICTE is not a body to grant financial assistance in order to pay

the teachers. It is either Union of India or the State Government or Institution which is required to pay the pay scale.

Sri M.S.Bhagwat, learned counsel for respondent No.1 was fair enough in stating before this Court that the AICTE is certainly not required to

make payment. Similarly, learned AGA appearing for respondents-2 and 3 and learned counsel for respondents-4 and 5 have also stated that AICTE

is not required to make payment.

The order passed by the learned Single Judge only to the extent it has held that the AICTE is also responsible for making payment of salaries and

arrears is modified. Otherwise also, the order passed by the learned Single Judge makes it very clear that the authority which is responsible for

payment of the salaries and arrears shall comply the order dated 30.07.2020.

With the aforesaid, the appeals stands disposed of.

Pending IAs., if any, shall also stand disposed of.
